Governor Schwarzenegger Signs Bill Targeting People of Faith

SB 1441 an Assault on Freedom of Organized Religion, Religious Schools

Governor Schwarzenegger signed SB 1441 (Kuehl-D) into law today. SB 1441 would require all businesses and organizations receiving funding from the state to condone homosexuality, bisexuality, and transsexuality or lose state funding. There is no exception for faith-based organizations or business owners with sincerely held religious convictions.

"This isn’t even a veiled attempt at subtly advancing the radical homosexual agenda," stated Karen England, Executive Director of Capitol Resource Institute. "SB 1441 is an outright, blatant assault on religious freedom in California."

This legislation will prevent parochial schools, such as private, Christian, Catholic, Mormon, and many other religious universities, from receiving student financial assistance if they also maintain a student code of conduct preventing behavior deemed immoral by their religious beliefs. By withholding state funding from schools, students’ educational opportunities will be severely limited. And limiting educational opportunities will result in a less diverse, less educated citizenry.

"As a citizen of California and a religious person, I am terribly disappointed in Governor Schwarzenegger," stated Meredith Turney, Legislative Liaison for Capitol Resource Institute. "It is bad public policy to add to the list of protected classes a sexual behavior. Equating sexual preference with the immutable characteristics of age, national origin or race will result in other variable behaviors being added to the list of invariable classes rightfully protected."

Forcing private education institutions to accept students engaged in behavior offensive to the school’s moral code is a serious infringement of the constitutional rights to freedom of assembly and freedom of speech.

"This bill is yet another attempt to prevent citizens with moral and religious principles from expressing their beliefs and educating their children according to those beliefs," continued England. "On behalf of California families, private schools and other private organization, I express our outrage at this attack on our freedom. Unfortunately for California families, there are several other radical homosexual bills heading towards the Governor’s desk."

AB 1207 – Preventing Free Speech in Elections (Yee-D)

This attack on religious candidates for public office would curtail their ability to express personal religious beliefs. AB 1207 would add to the Code of Fair Political Practices the requirement they not "use or permit any appeal to negative prejudices based on, sexual orientation or gender identity." Such language could be interpreted to mean that candidates are not allowed to support traditional marriage since that could be construed as appealing to negative prejudices about homosexuals.

SB 1437 – Homosexual Indoctrination in Schools (Kuehl-D)

This bill prohibits textbooks, teaching materials, instruction and "school sponsored" activities from "reflecting adversely" upon others based on actual or perceived gender and sexual orientation. This means the terms "mother and father" or "husband and wife" could be removed from textbooks because they reflect adversely upon homosexuals. This is the most blatant attack on California families thus far.

AB 606 – Superintendent of Public Indoctrination (Levine-D)

AB 606 was amended this week. It now requires the State Board of Education (instead of individual school districts) to increase sensitivity to so-called "discrimination." This amendment may be a response to criticism that mandating policies at the school district level constitutes "micromanagement." Either way, mandating these policies through a state department confiscates even more local control of school curriculum and policies. Policy decisions are best made at the local level, where parents and teachers are in direct contact with the needs of students. In yet another gigantic step towards total government control of education, the State Superintendent of Public Instruction (currently Jack O’Connell) will have unlimited discretion to withhold state funds from schools that do not comply with his interpretation of the law this bill would produce. Schools should focus on reading, writing and arithmetic, not trying to silence students’ freedom of speech and religion. No public official should have the power to blackmail schools into brainwashing students.

AB 1056 – Thought Police Redefine Tolerance (Chu-D)

This bill is the most blatant attack on freedom of speech and religion to date. AB 1056 integrates tolerance training into history and social science curriculum and starts pilot program that force students to learn a "new definition" of tolerance. According to this new definition, students will be forced to not only accept, but advocate homosexuality by "conveying respect" for a lifestyle that violates their religious beliefs. This is an outright assault on the freedom to not only speak out against homosexuality, but the ability to think it is immoral.

SB 2560 – Public School Health Center Expansion (Ridley-Thomas-D)

This Orwellian piece of legislation seeks to establish, retain and expand "health centers" in public schools. These health centers will collect data on children and then compile a biennial report on the collected data. AB 2560 allows school-based health centers to provide diagnostic and treatment services. This means that teachers and school staff may remove students from class, examine them and then "treat" them for maladies including "mental health disorders." School officials may also immunize students and provide counseling for "newer morbidities" such as teen sex, substance abuse, smoking, violence and behavioral problems. Under this legislation, the rights of parents to direct their children’s healthcare will be denied. School officials will possess the power to prescribe medication to students they believe have "behavioral problems."

SB 1471 – Sex Education in Schools (Kuehl-D)

This legislation would prohibit teaching or promoting "religious doctrine" in sex education classes. It also prohibits any teaching that "reflects or promotes bias" against people based on their sexual orientation. This legislation would apply to any school or program that receives state funding – it is not limited to public schools. Young children should not be exposed to sex "education" in schools – it is subject matter best left to the instruction and authority of parents. In addition, sex education classes could be prevented from sharing negative statistics about homosexuality if it reflects or promotes bias against sexual orientation. If schools are required to provide sex education, they should provide all the facts about risky sexual behavior. This bill would prevent accurate sex education in public schools.

SB 1827 – Joint Tax Filing for Domestic Partnerships (Migden-D)

This bill would permit domestic partners to file joint state income tax returns. This is the final benefit of "marriage" to be withheld from domestic partners by the state of California. All other rights and privileges of marriage have been granted to them. This bill is a backdoor attempt by the homosexual lobby to get state approval for homosexual "marriage."

AB 2510 – Bias Survey Promotes Homosexual Agenda (Lieu-D)

AB 2510 would require the Attorney General’s office, working with the State Department of Education, to survey students on bias-related discrimination and harassment incidents in public schools. 7th, 9th and 11th graders in public schools will be forced to fill out questionnaires asking whether they have experienced bullying, discrimination or harassment based on sexual orientation or gender (actual or perceived). Surveys of this nature are not only an invasion of students’ personal beliefs and experiences, they are an intrusion into the jurisdiction of parents’ authority. These surveys could also be used to search for isolated so-called "incidents" of harassment in order to bolster arguments for more pro-homosexual legislation, such as AB 606 and AB 1056.
